FEES AND PAYMENTS POLICY
1. WHO ARE WE?
Nextgen Fast Fashion Limited, a company incorporated under the laws of India, having its registered office at Floor-4, Plot-298/302, Court House Lokmanya Tilak Marg, Kalbadevi, Mumbai-400002, Maharashtra, India (“NGFF”, “We”, “Us” or “Our”), manage and operate the website www.sheinindia.in and the corresponding mobile and tablet applications (collectively referred to as “Shein India”). Through Shein India, we offer a variety of retail solutions and facilitate the sale and purchase of a diverse range of fashion and lifestyle, and other products (“Products”) to users of Shein India (“User” or “Users” or “You” or “Your”).
2. WHAT IS THIS FEES AND PAYMENTS POLICY?
2.1. This Fees and Payments Policy (“FPP Policy”), together with Shein India Terms and Condition, outlines NGFF accepted payment methods and the policies and procedures relating to the acceptance of fees and payments for services offered through Shein India. The primary objective of NGFF is to ensure that Shein India is User friendly and equipped with reasonably expected security infrastructure to protect any financial information shared by User(s).
2.2. User(s) are required to carefully read and understand the terms of this FPP Policy. If You do not agree with the terms outlined in this FPP Policy, You are advised not to accept Shein India’s Terms and Condition or this FPP Policy, and You may immediately cease using Shein India. The terms of this FPP Policy must be accepted without modification, and by using, browsing, accessing, or purchasing from Shein India, You agree to be bound by the terms contained herein, including any subsequent changes, modifications, or amendments made hereto.
3. FEES AND PAYMENT OPTIONS
3.1. NGFF does not currently levy any fees for browsing Shein India. However, NGFF may, in the future, consider levying fees on User(s) for accessing Shein India as a whole or for the use of certain features within Shein India. In such an event, You agree to pay any such fees as applicable. NGFF does not guarantee or covenant to provide You with prior notice before implementing such a fee. Your continued use of Shein India after the implementation of any such fees will constitute Your acceptance of these changes.
3.2. To ensure User convenience, NGFF offers multiple payment options. NGFF reserves the right, without prior notice to Users, to add or remove payment options from those listed below:
3.2.1. payment through net banking facilities;
3.2.2. payment through select credit cards;
3.2.3. payment through select debit cards;
3.2.4. payments through cash on delivery;
3.2.5. payments through prepaid payment instruments and electronic wallets;
3.2.6. Any other payment option that may be provided by NGFF from time to time.
The payment options referred to above shall hereinafter be collectively referred to as “Payment Options”. While reasonable efforts are made to offer Payment Options through various banking channels, NGFF currently accepts payments only from select major banking avenues. NGFF does not accept payments made through international debit/credit cards.
3.3. It is expressly clarified that the acceptance of a User’s payment through the Payment Options is solely at the discretion of NGFF. NGFF reserves the right to reject any payment made by a User through the Payment Options for any reason whatsoever.
3.4. While using the Payment Options, You agree to provide correct, complete, and accurate financial information, such as credit/debit card details or prepaid payment instrument account details, which may be stored by NGFF’s third - party payment gateway provider. User(s) shall not use a credit/debit card or prepaid instrument that is not lawfully owned by them or for which they have not been lawfully authorised to use. The User shall be solely responsible for the security and confidentiality of their financial information. NGFF disclaims all liability that may arise as a consequence of any unauthorised use of the User’s financial information and/or identity, including details relating to the Payment Options.
3.5. NGFF shall not be held responsible and assumes no liability for any loss or damage suffered by a User due to:
3.5.1. lack of authorisation for any transaction, including transactions carried out using vouchers issued to User(s) as part of NGFF’s promotions;
3.5.2. exceeding the credit/debit limit mutually agreed upon between the User and the issuing bank;
3.5.3. any payment issues arising from technical glitches occurring during a transaction; or
3.5.4. declination of a transaction for reasons beyond NGFF’s control.
3.6. NGFF reserves the right to impose limits on the number of transactions a User may undertake on Shein India. If a User exceeds the transaction limits imposed by NGFF, NGFF reserves the right to refuse to process such transactions. NGFF may also refuse to process transactions from User(s) who have a suspicious or questionable transaction history on Shein India. If NGFF is dissatisfied with the credibility of a User or the genuineness of a transaction carried out on Shein India, NGFF reserves the right to reject such transactions. Additionally, NGFF may choose to delay the dispatch of Products purchased by such a User or cancel the entire purchase at its sole discretion. The User agrees that NGFF shall not be liable for any damage, interests, or claims resulting from NGFF’s decision to not process a transaction or to delay processing a transaction due to the User’s suspicious activity on Shein India.
3.7. All Products listed on Shein India are inclusive of all applicable taxes. You are responsible for the payment of all fees, costs, and charges associated with the purchase of Products from Us, and You agree to bear any and all applicable taxes, including but not limited to service tax, GST, duties, and cesses. Despite NGFF’s best efforts, there may be instances of mispricing of Products on Shein India during or after the process of purchase has been completed by the User. While thorough verification processes are carried out prior to the publication of Product prices on Shein India, errors and discrepancies arising from technical glitches and time lags are unavoidable. For clarity, the actions of NGFF may take in the event of a price discrepancy between the actual maximum retail price of a Product and the price published on Shein India are set out below:
3.7.1. For the Users:
i. If the maximum retail price of the Products delivered to the User is lower than the price published on Shein India, the User must notify NGFF within 24 (twenty four) hours from the time of receipt of the Product(s) by calling 1800-889-5040 or by emailing Us at: customercare@sheinindia.in, in each case resulting in an acknowledgment. Upon NGFF’s satisfaction with the User’s claim, the difference between the maximum retail price of the Product and the discount availed by the User shall be provided as a discount coupon redeemable against future purchases on Shein India, within 10 (ten) business days from the date of receiving the written notice from the User. The discount coupon validity will be communicated by Us to the User.
ii. If the maximum retail price of the Product delivered to the User is higher than the price published on Shein India, NGFF reserves the right to withhold the dispatch of the purchased Products until the error on Shein India has been rectified and the User pays the difference amount. If the User refuses to pay the difference, they are entitled to seek a cancellation, and the monies paid by the User shall be refunded to the User’s source account used for the initial payment or transferred into the User’s bank account within 10 (ten) business days.
iii. To process such refunds, the User is required call us 1800-889-5040 or send an email to NGFF at: customercare@sheinindia.in. Upon receipt of this email, the User’s refund request will be processed. If the initial payment for the order was made via ‘cash on delivery’, NGFF may transfer the refund to the User’s bank account based on the User’s instructions within 10(ten) business days. If the initial payment was made through any other Payment Option, NGFF may transfer the refund to the User’s source account used for the initial payment within 10 (ten) business days.
3.8. To enable You to make payments for purchasing Products on Shein India, in addition to this FPP Policy, the terms and conditions of the Your bank, financial institution, and/or card issuing association may also apply. Your bank, financial institution, or card issuing association may decline or prevent You from making electronic payments for purchasing Products on Shein India. NGFF does not control these actions and, therefore, shall not be held liable for any issues arising from such declines or prevention.
3.9. NGFF may, from time to time, contract with third party payment service providers, including banks, to open nodal bank accounts under applicable Indian laws. This will be done to facilitate payments between User(s) and other third parties, in addition to NGFF. These third parties may include service providers such as payment aggregators, prepaid instrument providers, courier and logistic service providers, among others.
3.10. If You notice an unauthorized charge on Your payment instrument(s) for a purchase of Products on Shein India, You should first verify whether any of Your family members, friends, or business colleagues were authorised to carry out the purchase. If, after this verification, You are still unable to identify the charge, You may report the unauthorised purchase to Us by calling us at 1800-889-5040 or emailing customercare@sheinindia.in.within 3 (three) days from the date of the unauthorized transaction to enable NGFF to initiate an investigation. Upon receiving this information, We may attempt to cancel the order if the Product(s) have not yet been shipped to facilitate a return. If the Product(s) are already packed, You may reject the shipment or return the Product to enable a refund, subject to the terms and conditions outlined in the Cancellation, Return and Refund Policy.
3.11. If an order has been placed using Your card from an account other than Your own, You will be required to file a police complaint before Shein India can initiate any cancellation, return, or refund of such an order.
3.12. If a User completes a purchase on Shein India and the payment for that purchase is subsequently invalidated, NGFF reserves the right to:
(i) For Shein India: The User shall, within 5 (five) business days from the date of receiving written notice from NGFF, remit the Shein India Invalidated Payment into NGFF’s bank account, the details of which will be provided in the notice. If the User fails to remit the Shein India Invalidated Payment within the specified time, NGFF reserves the right to initiate civil and/or criminal legal action against the defaulting User at their own cost and risk.
3.13. Cash on Delivery: The ‘cash on delivery’ Payment Option allows Users to make a cash-only payment to Our delivery executive or logistics partner at the time of delivery of the purchased Products. Currently, We offer the cash on delivery Payment Option for a maximum order value of INR 2,500 (Rupees Two thousand five hundred) for Shein India. The Cash on Delivery Payment Option may be blocked for certain Users, specific Product(s), or certain locations/ pin codes. Cash on Delivery limits may also vary and may be lower for certain Users, specific Products, or certain locations/ pin codes. NGFF reserves the right not to provide Cash on Delivery Payment Option for certain Products (which may be specified by NGFF) or for Products exceeding a specified value, as well as for certain location/ pin codes. User(s) are required to review and accept the terms set out in the Cancellation, Return, and Refund Policy available at: https://www.SHEINIndia.in/return-refund-policy, which outlines the terms of refunds for transactions carried out using the cash on delivery payment option.
3.14. EMI: The EMI Payment Option allows Users to make staggered payments for the purchase of Products from Shein India. The EMI Payment Option is available only for payments made through eligible credit cards issued by select banks, as specified on Shein India. The terms and conditions of the relevant banks shall apply to all payments made using the EMI Payment Option. NGFF will not be responsible or liable for any issues or claims arising from the use of this Payment Option.
